National Human Rights Of Soldiers





Recently, a petition filed by the daughter of a retired army officer and a daughter of a serving army officer. The petitioners are seeking the formulation of a policy to safeguards the right of armed forces personnel on what could come under their ambit while discharging their duties in case of facing on unruly mobs or individual who attacks them while performing their military duty. The petitioner here citing various instances of violence against armed forces personnel, including stone-pelting in Kashmir.


 The petition seeks the human rights of a soldier must be protected in case of stone-pelting by a crowd on soldier in the entire country not only in the case of Kashmir. Since this situation aroused from a long time that stone-pelters taking advantage of their human rights and creating an uncontrolled situation in Kashmir as well as other states of India. This is really worst condition when a virtuous soldier performing their legitimate duty to protect and defend the people of India in Border areas, the crowd of people starts pelting stone on them and they even can't use their weapon as because the stone is not the weapon of war and our soldier can't retaliate them, instead they face such stone-pelting and getting injured and sometimes because of harsh condition, our soldier died. They even can't use their weapon because if they will, there will be a violation of the human right of the civilian.

 So to overcome these problems the National Human Rights Commission should make some provision regarded to the human rights of soldiers. As our soldier is giving their lives to protect our country and us from our enemies, providing us safe and free environment from terrorist and other unjust activities of our enemy countries, the government of India should enact pro-soldier policy regarding soldier rights to retaliate stone pelters and protect themselves.


   Now the petition under Supreme Court and the honourable court has said that it will take this matter seriously and will review all aspects related to soldier human rights. But what could be its final decision it will be decided after the final verdict.


  Government of India should intervene in such matter related to our honoured shoulder as they are governed and directed by the orders of President of India. The government should make them free to perform their legitimate duty and make some policy that protects them from stone pelters in their own way as they did in soldier style.

 If we look at globally, China directed its soldier to fire on stone pelters if they will not listen quietly and peacefully. This move of China shows that it takes care of both civilian as well as their soldier but first giving them the opportunity of peace and then retaliation. Government of India should also take similar steps to protect a soldier from being harassed by a mob or crowd.

 As sometimes mentioned in newspapers that these stone pelters are working for the terrorist organisation and by using stone they want to show that they protect themselves as a civilian since stone is not regarded as the weapon of war, so they are taking advantage of their human rights of protecting against soldier as a civilian.


    The best way forward that the government of India should form a panel and look into this serious issue which is related to our soldier, means they are related to unity and integrity of India. Such issues have to take seriously as they are related to the country's security, do not take them lightly they might cause serious damage and disastrous problems to our nation.
